Kanimozhi bail plea deferred till Oct 17

NEW DELHI, INDIA: As the trial court, headed by Justice OP Saini, is yet to frame charges, the bail pleas of DMK MP Kanimozhi and Sharat Kumar, managing director, Kalaignar TV will be heard on Oct 17.

Both the investigating agency and Kanimozhi lawyer wanted a fresh date on which the bail application to be heard.

Speaking to CIOL, Kanimozhi lawyer S J Aristotle said that the Supreme Court has directed the trial court to reconsider the bail plea of the accused in view of liberty given under section 437 CrPC and reconsider the bail plea of the accused. The section allows bail to accused, if the applicant is woman or have ailment.

The apex court, however, was in a view that a bail can’t be granted before the framing of charges by the investigating agency.

“We will also be opposing the section 409 CrPC imposed by the investigating agency as we have a time till Oct 7,” Aristotle informed.

The bail pleas of Kanimozhi and Kalaignar TV managing director, Sharat Kumar will be heard on October 17, as the CBI is expected to frame the charges by October 15 for being alleged beneficiaries in the 2G spectrum allocation scam.

The bail pleas of other accused A Raja’s former private secretary RK Chandolia, Swan Telecom promoter Shahid Usman Balwa, director of Cineyug Films Karim Morani and directors of Kusegaon Fruits and Vegetables Asif Balwa and Rajiv Agarwal will be heard on Monday.

Sources, however, believe that trial court might take a lenient view on Kanimozhi and Morani under section 437 CrPC on Oct 17.
