CMDA arbitrates 14 cases

PUNE, INDIA: In a bid to resolve issues pertaining to IT trade in the region, Computer and Media Dealers Association (CMDA) Pune successfully closed all the 16 cases for arbitration during the financial year 2008-09. While the managing committee had resolved 12 arbitrations in 2008, two of the cases were rejected on grounds that they were not fit for contention.

However, it took the committee six months to resolve the remaining two arbitrations which were closed this week.

Shital Nahar, President CMDA stated, “During my term as the President, CMDA had received about 16 arbitrations of which two cases were rejected and 12 were successfully resolved. Two were pending owing to the complications involved. However, in the second week of June we closed the remaining cases.”

Refusing to divulge the names of the parties involved in each of the cases, Nahar indicated that both cases were related to payment defaults from parties who were members of the association. “In the first case, one of the three directors of the alleged defaulter company had quit and hence resolving the case was getting increasingly difficult for the committee. In the second case, the defaulting company had closed its operations. However, it was only after my involvement, alongside support from the legal arbitrator, and the Naresh Lalwani, VP, CMDA, that the matter was resolved amicably and the defaulting parties have now agreed to pay the pending amounts,” added Nahar.

When asked whether CMDA is looking at appointing a third party (outsider) as the legal arbitrator on grounds that a committee member will always pass a biased judgment, Nahar opined that CMDA has always believed in being neutral.

“As an association we look at resolving any issue amicably and maintain an unbiased approach. There was an instance wherein there was a dispute between one of our members and a distributor owing to payment issues and we passed the judgment in favor of the distributor. If need be, in future we may look at appointing an outsider as a legal arbitrator,” he added.
