Chidambaram's video next, claims YouTube user

NEW DELHI, INDIA: Even as the social network platforms embarrass Congress stalwart Abhishek Manu Singhvi despite the court restrain on alleged sex video, a YouTube user claims that a video involving Home Minister P Chidamabaram will be posted soon.

In an absolute defiance with legal exertions, a video featuring Singhvi with a lawyer has gone viral. Recorded in a poor lit court’s chamber room, the video, albeit grainy, depicts consensual sex.

The content on social sites gets another dimension. Is it freedom or abuse? The phenomenon is perhaps, picturesque for some but to others, it’s somber. This, however, confront Google and Facebook's own privacy policies.

As the Singhvi video gets thousands of hits within hours, a YouTube user by name 'Sikh-Hindu Nationalist' claims that Chidambaram’s CD with Russian prostitutes will come soon.

Speaking to CIOL, a senior top court counsel and techno-legal expert Praveen Dalal said that such statements are not only defamatory but also deserve to be taken seriously from the prosecution point of view.

Without actual and conclusive proof, he believes that any such statement is simply libelous and defamatory, and these users can be prosecuted by a person or an institution affected by such statement.

The video clip on social sites, despite judiciary’s restraint order is a contempt of court and proceedings can be initiated against the user who uploaded the clip, said Dalal.

If a social media website, he said, fails to remove an offending content within 36 hours of intimation made to it, such social media Website can be prosecuted in India.

The cyber law of India, incorporated in the Information Technology Act, 2000, mandates exercise due diligence by all Websites. This, he said, is sufficient for regulation of social media Websites for now.

A Facebook user, registered under the ‘artist category’ as ‘Singhvi Video’ shared a video link. The video is divided into four clips of 4.01, 12.41, 3.32 and 9.31 minutes each.
