Supreme Court okays 27 p.c. OBC quota

NEW DELHI, INDIA: In an important ruling, the Supreme Court today upheld 27 per cent reservations for the Other Backward Classes (OBCs) in premier central educational institutions.

The court however, excluded the creamy layer from the reservations, adding that reservation cannot be permanent and appear to perpetuate backwardness.

The ruling was reserved in November 2007 following a hearing lasting four months.

With this ruling the IITs and IIMs can implement the reservations from the academic session 2008-`09 itself.

Solicitor general G E Vahanvati, former attorney general K Parasaran and additional solicitor general Gopal Subramaniam presented the center’s argument without excluding the creamy layer.

Anti-quota petitioners represented by senior advocates Fali S Nariman, Harish Salve, Rajeev Dhawan, K K Venugopal and P P Rao questioned the basis of the law.
