Sun Micro fined for breaking export rules

SAN FRANCISCO: The U.S. Department of Commerce has asked Sun Microsystems Inc. to pay a fine after finding it broke record-keeping requirements on exports to Syria, the company said in a regulatory filing on Wednesday.



The network computer maker has requested an extension until Dec. 1 to file a formal response to the request.



In its quarterly report filed with the U.S. Securities and Exchange Commission, Sun said it was likely to reach a negotiated settlement with the agency but would vigorously defend itself in an administrative hearing if it was unable to settle the charges.



The office of export enforcement within the Commerce Department has informed Sun of two suspected violations regarding sales to Syria, though the company was told it would not be charged for one of the two, Sun said.



The office has asked Sun to pay a small cash penalty to settle the charge related to the other violation, the company said.



Sun faces a series of allegations by the Commerce Department over exports to Egypt, China and other countries, and over the way it recorded those transactions. The department has proposed a settlement that would include a fine.
