Cyber India Online (CIOL) is an Information Technology-related service which has been created to be easily accessible to all users, but it has limitations and risks which must be made known to the users before participating. By using the Service User are consenting and agreeing to abide by these terms. CIOL will not be held liable for any breach of terms and conditions arising from user's misunderstanding of the following materials. CIOL reserves the right to change, cancel or introduce new terms and conditions in the Agreement in its discretion at any time, and without prior notice. Users will be notified of changes immediately upon issuance of the new agreement as shown on the site. Continued usage of the Service by the User shall be deemed as an agreement to the new Terms and Conditions.

TERMS AND CONDITIONS

1. Copyright/ Use of Content
CIOL holds all rights to any and all Contents in the Service. Contents includes information, graphics, software, photographs, audio and video clips, graphics, links and all other materials contained in the Service. User realizes that the Service contains Contents which are supplied by CIOL and other third parties not affiliated with CIOL, and thus User may not abuse the allowed usage of these Contents, acknowledging also that these Contents are protected by copyrights, trademarks and other propriety laws implemented by CIOL and other third parties. User may acquire any Content in the Service ONLY for User's personal usage, at User's own discretion, as long as User maintain all copyright and other notices contained in such Content. Unless otherwise indicated, any unauthorized copying, redistribution, modification, storage or publication of any Content is strictly prohibited without the express consent of CIOL. 
Note : User discretion will include the following considerations. Users may not change, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display or in ANY way exploit the PERSONAL usage agreement mentioned above.

2. Conduct Ethics
CIOL views postings of any and all offensive Contents through the Service by the User as a breach of Conduct Ethics. It is unethical to distribute or post offensive and unwanted Contents in the Service. CIOL will remove any such postings at its own discretion and will not notify of User of such removal. CIOL reserves the right to limit the User of access into any or all of the Service as a direct result of offensive conduct, which includes language, photography and any such form of communications.

Such Content as mentioned above includes without limitations, profane or sexually explicit postings that include masking or misspelling the words, or images that would be illegal in any jurisdiction. In detail, anything which is considered libelous, defamatory, obscene, pornographic, abusive, harassing or threatening shall be removed from postings and the User shall be held liable for any counteractions as seen fit by CIOL. Contents mentioned includes also any Contents with contaminative features or viruses, Contents which violates the copyright, trademark, or other such propriety, privacy or publicity laws and any Contents which violates any applicable law.

CIOL is not responsible for Contents submitted by the User, and does not and cannot review such Contents. The User shall remain responsible for all Contents posted/submitted by the User. CIOL cannot be held liable for any and all of the above mentioned Contents. CIOL does, however, reserves the right to modify, remove or move any Content as CIOL sees fit, including also all and any Content in the Interactive Areas.Note: It is important for the User to realize that the User may not in any way add a link in the Interactive Areas which serves marketing purposes for anything other than CIOL Services.

CIOL opposes SPAM! All activities related to SPAMming are STRICTLY prohibited in the Service.

3. Disclaimer of Warranties; Limitation of Liabilities
The service is provided on an "as is as available" basis. CIOL expressly disclaims all warranties of any kind, whether express of implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. The user agrees that use of the service is solely at the users risk. Nothing (either advice or information) obtained from CIOL will act as a warranty not expressly stated herein. User agrees that neither CIOL or any third party shall be liable for any direct, indirect, incidental, special, consequential or exemplary damages, resulting from the use or the inability to use the service or for cost of procurement of substitute goods and services or resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service or resulting from unauthorized access to or alteration of user's transmission data or arising from any other matter relating to the service, including but not limited to, damages for loss of profits, use, data or other intangible, even if CIOL has been advised of the possibility of such damages.

4. General
This agreement is complete and is the exclusive agreement between the parties with respect to the subject matter hereof, superseding any prior agreements and or communications regarding such subject matter. This agreement may be modified in any way only by a written document executed by all parties.

The laws of the Republic of India shall govern this document containing the User Terms and Conditions Agreement. All parties irrevocably consent to bring any action to enforce this Agreement in the courts located in Bangalore, Karnataka.

It is CIOL's wish that all Users have read and understood all the Terms and Conditions before agreeing. By agreeing CIOL means any and all usage of the Service, after/before the reading of this Agreement. At the instance that a User refuses to agree to this, the User shall immediately cease to use the Service.
