NEW DELHI: The Consumer Disputes Redressal Forum recently fined Vodafone Essar Limited a sum of Rs 20,000 for activating a 'cheap and vulgar' caller tune on a female lawyer's mobile phone without her consent, The Times of India reported on Tuesday.

According to the report, a caller tune, Bheegi bheegi raton mein, was activated on Neena Chakravorty's mobile phone in December 2007, "shattering her professional personality" as it carried a "nonsense message of love and lust".

Chakravorty claimed that the caller tune had been activated at a time when she was representing actor Sanjay Dutt's wife Rhea Dutt in their divorce proceedings. She claimed that she was "utterly embarrassed" when her clients had to listen to the cheap caller tune which she said ruined her reputation.

Despite several attempts, the service provider's customer care reportedly did not deactivate the caller tune for about two weeks. Chakravorty was advised to send SMS CAN CT to 144 for the cancellation. However, she could not send the SMS as her message box was not functioning properly at that time.

Vodafone argued that the caller tunes do not get activated by default and said it got activated on her mobile as she had pressed key no 3 from the option given in the auto-dialler, it claimed.

The court, however, observed that a practising lawyer would not ask for such a caller tune. Chakravorty said that though she had sent a legal notice on December 20, 2007, which was admittedly received by Vodafone, they did not reply to it.

vodaphones services are really bad, they activate call divert without customers concent, they dont forward the incoming sms while international roaming, and over and above they dont listen for this problems from last 5 years, i am just waiting when can get the facility to use the same number on another service providers
